What is mediation?
Mediation is an alternate dispute resolution (ADR) process of negotiation for the resolution of a dispute or conflict between two or more parties assisted with the help of a third-party neutral (the mediator). The mediator is there to facilitate communication between the parties, help them in focusing on the real issues of the dispute or conflict, and to help the parties generate their own options that address the issues and meet the interests or needs of all parties in an effort to resolve the dispute or conflict. The mediator has no power to force a decision upon either party at the mediation. The mediation is voluntary process that the parties attend because they want to resolve the dispute. A successful mediation is all parties at the mediation agreeing an outcome that they can all live with. back |
